Welcome to Hexoria (the "Service"), available at hexoria.cc. These Terms of Service ("Terms") govern your access to and use of the Service, which is provided by Hexoria ("we," "us," or "our"). Please read these Terms carefully before using the Service.
1. Acceptance of These Terms
By accessing or using the Service in any way — including browsing the website, using any of our tools, or interacting with any content — you agree to be bound by these Terms. This is a legally binding agreement between you and Hexoria.
- Acceptance by use. If you access or use the Service, you confirm that you accept these Terms and agree to comply with them.
- Acceptance by acknowledgment. Where the Service asks you to confirm your acceptance, clicking "I agree" or a similar action also constitutes acceptance.
- Age requirement. You must be at least 13 years old to use the Service. If you are between 13 and the age of majority in your jurisdiction, you must have permission from a parent or legal guardian, who agrees to be bound by these Terms on your behalf.
- If you disagree. If you do not agree to any part of these Terms, or to any future revision of them, you must not access or use the Service.
2. The Service
Hexoria provides a collection of free, accessible communication tools and guides — including communication boards, phrase boards, voice aids, sentence generators, and practice tools — designed to support people who communicate differently.
- What the Service is. The Service includes the website, all tools, written guides, illustrations, and related content made available through hexoria.cc.
- Limited license. We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for its intended, personal, non-commercial purposes, subject to these Terms.
- Availability. The Service is provided free of charge. We may update, modify, suspend, or discontinue any part of the Service at any time, with or without notice.
- Privacy & offline use. Our tools are designed to work on your own device. We do not require you to create an account, and we do not collect, store, or process the words, messages, or practice data you create in our tools on our servers.
3. User Rules & Responsibilities
When you use the Service, you agree to the following rules and accept responsibility for your own conduct:
- Use the Service lawfully. You agree not to use the Service for any illegal, harmful, or unauthorized purpose, and to comply with all laws, rules, and regulations applicable to your use of the Service.
- Do not interfere. You must not interfere with or disrupt the Service, its servers, or any networks connected to the Service, and you must not attempt to gain unauthorized access to any part of the Service.
- Do not misuse the tools. You may not use our communication tools to harass, threaten, defame, deceive, or harm other people, or to create content that is unlawful, obscene, or infringing.
- No reverse engineering. You may not copy, modify, decompile, reverse engineer, or create derivative works of the Service, except to the extent expressly permitted by law.
- Be accurate and honest. If you use the Service to represent yourself (for example, using a phrase board in a medical or emergency setting), you are responsible for ensuring that the phrases you choose accurately reflect your situation.
- Account security. If any feature of the Service ever requires an account, you are responsible for all activity that occurs through your account and for keeping your login credentials secure. You must notify us immediately of any unauthorized use.
4. Accounts, Termination & Suspension
The Service is currently designed to work without an account. All tools run on your own device, and no registration is required. This section applies if you create an account for any future feature, and to the Service in general.
Your right to stop using the Service
- No account — no steps needed. Because the Service does not require an account, you can stop using it at any time simply by closing the website. Data you create in the tools (such as practice logs) is stored only on your own device and can be deleted by you at any time.
- Account deletion. If we introduce accounts in the future, you may delete or deactivate your account at any time using the account settings or by contacting us at [email protected]. Upon deletion, we will remove the personal information we hold for your account, subject to our legal obligations.
Our right to suspend or terminate
- Breach of these Terms. We may terminate or suspend your access to the Service immediately, without prior notice or liability, if you breach these Terms, including but not limited to misuse of the tools or unlawful activity.
- Necessary maintenance. We may temporarily suspend all or part of the Service for maintenance, repair, upgrades, or security reasons, with or without notice.
- Survival. All provisions of these Terms which by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, indemnification, dispute resolution, and governing law — shall survive termination.
5. Intellectual Property
The Service and its original content, features, and functionality — including text, graphics, logos, illustrations, tool designs, layouts, and software — are and will remain the exclusive property of Hexoria and our licensors. The Service is protected by copyright, trademark, and other intellectual property laws.
- What belongs to us. All rights in and to the Service not expressly granted to you in these Terms are reserved by us.
- Trademarks. The name "Hexoria", the Hexoria wordmark and logo, and any related trade dress may not be used in connection with any product or service without our prior written consent.
- Personal, non-commercial use. You may print or save the guides and tool instructions for your own personal use, but you may not republish, resell, or distribute the Service's content without permission.
6. User Content & What You Generate
Because the Service is designed to help you express yourself, it is important to be clear about ownership of what you create.
- You own what you generate. Messages, sentences, phrases, and practice records that you create using our tools are your content. We make no claim of ownership over them, and they are not uploaded to, stored on, or shared through our servers.
- You are responsible for it. You are solely responsible for the content you generate and how you use it, including its legality, reliability, and appropriateness.
- No license to us. Because your content never passes through our systems, no license to your content is needed. If you choose to share content with us (for example, feedback or testimonials), you grant us a non-exclusive, worldwide, royalty-free license to use, modify, publicly display, and reproduce that content for the purpose of improving and promoting the Service, and you represent that you have the right to share it.
7. Third-Party Links & Materials
Our Service may contain links to third-party websites or services that are not owned or controlled by us, and may reference third-party materials such as guide images. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services. We encourage you to read the terms and privacy policies of any third-party site you visit.
8. Disclaimers
YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK. THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. THE SERVICE IS PROVIDED WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.
- No medical or emergency guarantee. The Service provides communication aids only. It is not a medical device, a professional medical opinion, or a substitute for emergency services. In an emergency, always contact your local emergency number.
- Voice features depend on your device. Speech synthesis is performed by your browser or device. We do not guarantee that a particular voice will be available, or that speech output will be error-free.
- No warranty of results. We do not warrant that the Service will be uninterrupted, secure, or error-free, or that the results obtained from the Service will be accurate or reliable.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL HEXORIA, NOR OUR DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (i) YOUR ACCESS TO OR USE OF THE SERVICE, (ii) YOUR INABILITY TO ACCESS OR USE THE SERVICE, (iii) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE, OR (iv) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.
IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF THE SERVICE EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID, IF ANY, FOR ACCESS TO THE SERVICE, OR (B) ONE HUNDRED DOLLARS (US $100.00).
10. Indemnification
You agree to defend, indemnify, and hold us harmless from and against any and all claims, damages, obligations, losses, liabilities, costs, or debts, and expenses (including but not limited to attorney's fees), resulting from or arising out of (a) your use and access of the Service, (b) your violation of any term of these Terms, (c) your violation of any third-party right, including without limitation any copyright, property, or privacy right, or (d) any claim that your use of the tools caused damage to a third party.
11. Changes to These Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If we make material changes, we will take reasonable steps to notify you, including by updating the "Last Updated" date at the top of these Terms and, where practical, posting a notice on the Service.
- Notice period. We will try to provide at least 30 days' notice prior to any material changes taking effect. What constitutes a material change will be determined at our reasonable discretion.
- Continued use. By continuing to access or use the Service after revised Terms become effective, you agree to be bound by the revised Terms. If you do not agree to the revised Terms, you must stop using the Service.
- Archived versions. If you would like to review an earlier version of these Terms, you may contact us at [email protected].
12. Dispute Resolution
We hope that any concern can be resolved quickly and amicably. Please follow this process:
- Step 1 — Contact us first. Before starting any legal proceeding, contact us at [email protected] and describe your concern in reasonable detail. We will work with you in good faith to resolve the issue informally.
- Step 2 — Informal resolution period. We will have 30 days from receiving your notice to respond and attempt a resolution. If the matter is not resolved within that period, either party may pursue the remedies described below.
- Step 3 — Small claims. Either party may bring qualifying claims in small claims court, regardless of the informal process described above.
- Step 4 — Binding arbitration. Except for claims that may be properly brought in small claims court, any dispute, controversy, or claim arising out of or relating to these Terms or the Service shall be resolved by binding arbitration administered in accordance with the rules then in effect of the American Arbitration Association, before a single arbitrator.
- Individual basis only. Any arbitration or proceeding shall be conducted on an individual basis. You waive any right to participate in a class action, class-wide arbitration, or any representative proceeding, except where such waiver is prohibited by law.
13. Governing Law & Jurisdiction
Governing law. These Terms and any dispute arising out of or relating to them or to the Service shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.
Jurisdiction. You agree that, to the extent arbitration is not required or permitted under Section 12, any legal suit, action, or proceeding arising out of or related to these Terms or the Service shall be instituted exclusively in the state and federal courts located in the County of San Francisco, State of California, United States. You irrevocably submit to the exclusive jurisdiction of such courts and waive any objection based on improper venue or forum non conveniens.
Place of arbitration. Any arbitration under Section 12 shall take place in the County of San Francisco, the State of California, United States, unless the parties agree otherwise in writing.
14. Entire Agreement
These Terms constitute the entire agreement between you and Hexoria regarding your use of the Service and supersede and replace any prior agreements (whether written or oral) between you and us regarding the Service.
- Severability. If any provision of these Terms is held to be invalid or unenforceable, that provision shall be enforced to the maximum extent permissible and the remaining provisions shall continue in full force and effect.
- Waiver. Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision.
- Assignment. You may not assign or transfer these Terms or your rights under them without our prior written consent. We may assign these Terms without restriction.
